These Terms of Service ("Terms") govern your access to and use of NodaFlow's website and platform (the "Service") operated by NodaFlow ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least 16 years of age, have the legal capacity to enter into this agreement, and accept these Terms in full. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
NodaFlow provides a visual AI agent builder platform that allows users to design, configure, and execute automated workflows connecting large language models (LLMs) with external APIs and Model Context Protocol (MCP) servers. The Service is provided as a web-based SaaS application.
3. Account Registration
You must create an account to use the Service. You agree to:
- Provide accurate and complete information during registration
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activity that occurs under your account
We reserve the right to refuse service, terminate accounts, or remove content at our discretion.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Generate, transmit, or distribute illegal, harmful, fraudulent, or abusive content
- Conduct unauthorized data collection, scraping, or systematic access of third-party services in violation of their terms
- Attempt to reverse engineer, decompile, or disassemble the Service
- Use the Service to build a competing product or to resell access without authorization
- Overload, disrupt, or otherwise interfere with the integrity or performance of the Service
- Impersonate any person or entity or misrepresent your affiliation
5. Third-Party Integrations
The Service allows you to connect third-party services and APIs. You are solely responsible for ensuring your use of those integrations complies with the relevant third-party terms of service. NodaFlow transmits your data to AI model providers (such as OpenAI or Anthropic) on your behalf when you use corresponding nodes. We are not responsible for the behavior, availability, or data practices of any third-party service.
6. Intellectual Property
The Service and all its original content, features, and functionality are and will remain the exclusive property of NodaFlow. Nothing in these Terms transfers any intellectual property right to you.
You retain ownership of the workflows, data, and content you create using the Service. By using the Service, you grant NodaFlow a limited, royalty-free license to process and store your content solely as necessary to provide the Service to you.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Limitation of Liability
To the maximum extent permitted by applicable law, NodaFlow and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Actions or outputs of AI models or third-party APIs connected through the Service
9. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. AI-generated outputs may be inaccurate and should not be relied upon without human verification.
10. Termination
We may suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.
You may terminate your account at any time by contacting admin@nodaflow.com. Upon termination, your right to use the Service will cease, and we may delete your account data in accordance with our retention policy.
11. Governing Law
These Terms shall be governed by and construed in accordance with French law, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide reasonable notice of significant changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
